On 30 April 2014, the Australian Human Rights Commission released its decision on the BSWAT Disability Discrimination Act 1992 exemption application.

An exemption for a 12 month period has been allowed for ADEs to use the Business Services Wage Assessment Tool (BSWAT) to:
(a) assess wages for employees; and
(b) pay wages to ADE employees based on assessments conducted under the BSWAT
while the relevant ADE services tranistion to a new wage assessment stystem.
